Some states require notice to be sent within 30 days and some within 60. Another problem seen when waiting too long to file a claim is that often, evidence can be misplaced or destroyed as time goes by. Also if there are any witnesses in the case, they may be hard to locate due to a move or other circumstance that may have occurred since the time of the accident.

In addition to the above mentioned scenarios that can occur in waiting to file a personal injury claim, there is the human element to consider. Unfortunately, human memory has been known to fade or distort, or even downplay incidences after a long period of time. This is especially true when dealing with people who were not directly effected by the incident such as co-workers or police officers. When a person is in an accident or becomes injured due to another occurrence that is through no fault of their own, they may be entitled to damages for lost wages and/or medical expenses. First, never smile in a photograph that is going to be used evidence of an injury. This will give of the appearance that you are taking the situation too lightly and therefore must not be in that much pain. In addition, never wear jewelry or make up, and dress as casual as possible. Make sure that whatever room the pictures are being taken in is free of distracting items such as clutter, and mirrors or other equipment that may take the attention off the person being photographed. Make sure that all photos are clear and emphasize the injury, and that the lighting is good in the room. These are some very basic tips on how to get the best possible photographs when taking them for a personal injury case.
